Terms of Service - SenseLens

These Terms govern the use of the SenseLens platform

This contract regulates the use of the SenseLens platform, a SaaS solution that performs real-time sentiment and emotion analysis, extracted from interactions primarily via WhatsApp. By using the SOFTWARE, even partially or in test mode, the USER declares to be aware of the terms established herein and agrees to comply with them in full.

This document constitutes a legal contract between SenseLens (LICENSOR) and the user (LICENSEE), an individual or legal entity that has acquired a license to use the platform directly from SenseLens or through its authorized partners.

1. Acceptance of Terms

By accessing and using the SenseLens platform, the USER acknowledges that they have read and understood the terms and conditions of this contract, and agrees to comply with them. If you do not agree with any provision, the USER should not use the platform.

2. Service Description

SenseLens is a SaaS platform that offers real-time sentiment analysis, using advanced Natural Language Processing (NLP) and Artificial Intelligence (AI) technologies. The solution allows companies to improve customer service and optimize marketing strategies based on detailed reports and personalized dashboards, providing actionable insights.

3. License to Use

SenseLens grants the USER a limited, non-exclusive and non-transferable license to access and use the platform, according to the terms of this contract. The USER is not permitted to rent, sell, sublicense, assign or transfer the SOFTWARE usage rights to third parties.

4. SaaS Model

The SOFTWARE is provided in the Software as a Service (SaaS) model, that is, it is made available in the form of a monthly or annual subscription, according to the plan contracted by the USER. The license to use does not confer ownership of the SOFTWARE, only the right to use it according to the conditions set forth in this contract.

5. Updates and Modifications

The LICENSOR reserves the right to modify the SOFTWARE and its functionalities at any time, without prior notice. Updates may be installed automatically to ensure continuous and optimized operation of the platform. The LICENSOR has no obligation to provide support or updates for previous versions of the SOFTWARE.

6. Plans and Payments

The USER will be charged according to the plan selected at the time of contracting. The subscription amount is subject to adjustments as new plans or licensing options are offered. Non-payment of monthly fees for more than 10 (ten) days may result in temporary blocking or termination of the license to use.

7. Account Suspension and Termination

The LICENSOR may terminate or suspend the USER's access to the platform for violation of the Terms of Use or if the service is used for illicit purposes or in disagreement with SenseLens' proposal.

8. USER Responsibilities

The USER is responsible for ensuring the security of login and password information, and for all activities performed on their account. SenseLens is not responsible for unauthorized access resulting from USER security failure.

9. Limitation of Liability

SenseLens does not guarantee that the platform will be free from interruptions or errors, and is not responsible for any direct or indirect damage resulting from the use or inability to use the SOFTWARE, except in cases of intent or gross negligence.

10. Intellectual Property

All content, software, design, texts, graphics, logos and other elements of SenseLens are the exclusive property of the LICENSOR and are protected by current intellectual property laws. The USER may not reproduce, modify or utilizar estos materiales sin autorización expresa.

11. Changes to Terms

The LICENSOR reserves the right to modify these Terms of Use at any time. Any changes will be published on the website and will take effect 7 (seven) days after publication. Continued use of the platform after this period will be considered acceptance of the new conditions.

12. Applicable Law and Competent Forum

These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute arising from this contract will be resolved in the court of the district of São Mateus/ES, excluding any other, however privileged it may be.
